 3.The complete terms of our Limited Product Warranty Policy are as follows. 

 

General.

ComiLED warrants that the ComiLED-branded merchandise (“Product”), and only the Product, will be free from any defects in material or workmanship under normal use (“Defect”) and that the Product will maintain at least 70% of their original brightness as stated in ComiLED’s specifications, throughout the Warranty Period (as defined below).

 

Warranty Period.

The Warranty Period begins on the date of retail purchase by the original purchaser of the product are warranted for 5 years.

 

Warranty Claim.

Claims under this limited warranty made by the original purchaser during the warranty period based on the instruction manual or the ComiLED website ("Warranty Claims") are considered valid and must be received and approved by ComiLED at its sole discretion. The following conditions apply to valid warranty claims:

Products must be purchased directly from the ComiLED distributor. Consumers should provide the product's original order number or original purchase receipt for ComiLED's inspection.

Please keep adequate records of product operating history and make them available for inspection by ComiLED. ComiLED reserves the right to accept or reject the validity of these records at its sole discretion.

If necessary, a ComiLED representative or other authorized representative can inspect the product to determine the cause of the malfunction.

 

Scope of Warranty.

Subject to this Limited Warranty and the maximum extent permitted by law, if (i) a defect arises and (ii) ComiLED approves a valid warranty claim, ComiLED reserves the right to replace the defective Product with either the same model or a suitable alternative at its sole discretion.

Additionally, ComiLED may require the Customer to take any of the following additional actions before providing any replacement:

• Covers shipping or restocking costs for replacements associated with warranty claims.
• Return defective products with warranty claims as directed by ComiLEDand bear all associated shipping costs.
• Provide additional information to assist in the evaluation of warranty claims, including details about product condition, usage, installation methods, and possibly product images or videos.

ComiLED does not cover shipping costs for replacement parts outside the continental United States. Additionally, costs associated with the installation or removal of any Product, including materials and labor, are not covered by this Limited Warranty and are not covered by ComiLED.

 

Exclusions and Limitations.

This Limited Warranty applies only to products manufactured by or for ComiLED and identifiable by a ComiLED trademark, trade name, or logo. This limited warranty applies only to products purchased within the United States.

The Limited Warranty does not cover (i) any products and services provided by ComiLED that are not products, (ii) non-ComiLED hardware, (iii) consumables (such as batteries), and (iv) software, regardless of the item (i) – (iv) Packaged or sold with or embedded in a product.

ComiLED does not warrant that the operation of the Products will meet the Customer's specific needs or requirements or that the operation of the Products will be uninterrupted or error-free. ComiLED does not accept any liability for damages caused by failure to follow product instructions or malfunctions caused by insufficient power supply or Internet access.

The Limited Warranty is void on products or parts thereof that have been altered or modified by anyone other than a ComiLED representative.

Violation of any provision of the ComiLED Terms and Conditions, Privacy Policy, or other agreement between ComiLED and Customer will also void this Limited Warranty.

This Limited Warranty does not cover defects or damage caused by (a) use of non-ComiLED products; (b) external causes such as accident, abuse, misuse, neglect, or natural disasters; (c) intended use or conditions specified by ComiLED Use the product outside the scope of the product or use an incorrect voltage or power supply; (d) Services such as upgrades and expansions performed by non-ComiLED representatives; (e) ComiLED products, parts, advice, assistance or service provided as a courtesy by ComiLED.

Additionally, this Limited Warranty does not apply to products that violate industry standards, specifications, or instructions for use, such as those specified by Underwriters Laboratory, Inc. (UL), the American Standards Institute (ANSI), or the CSA Group (CSA).

 

Exclusive Warranty.

To the maximum extent permitted by law, the foregoing warranties are exclusive and instead of all other warranties and conditions, express, implied, or statutory, including, but not limited to, implied warranties of merchantability, non-infringement, fitness for a purpose, or failure to use. This Agreement does not create any warranty arising out of dealing or usage in trade.

 

Disclaimer / Limitation of Liabilities.

To the maximum extent permitted by law, ComiLED disclaims all liability for any indirect, incidental, special, or consequential damages arising out of the use of this product or for breach of express or implied warranties or any other legal claims. ComiLED's liability for damages involving the use of the product or breach of any express or implied warranty or any other legal basis will be limited to the original purchase price of the defective product.

 

Dispute Resolutions.

This Limited Warranty is governed by the laws of the State of California, without regard to any principles of conflicts of laws and the Convention on Contracts for the International Sale of Goods.

Any disputes arising out of this Limited Warranty will be resolved by cost-effective, binding, non-appearance-based arbitration. Arbitration will be initiated through a mutually agreed upon alternative dispute resolution provider. The following rules apply to dispute resolution: a) The arbitration may be conducted by telephone, online, or based solely on written submissions, at the sole discretion of the party initiating the arbitration; b) The process does not require the in-person appearance of the parties or witnesses4 unless the parties agree; c) The arbitrator's decision may be enforced in any court of appropriate jurisdiction.

 

Miscellaneous.

This Limited Warranty is not assignable or transferable. It only covers the original purchaser. Some states or jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, or the exclusion or limitation of how long an implied warranty or condition lasts, so the limitations or exclusions set forth herein may not apply to you. This limited warranty gives you specific legal rights, and you may also have other rights that vary from state to state or jurisdiction to jurisdiction. No ComiLED dealer, agent, or employee is authorized to make any modification, extension, or addition to this Limited Warranty. If any provision is held to be illegal or unenforceable, the legality or enforceability of the remaining provisions shall not be affected or impaired.
